Q: How does the Guarantee work ?

A: Receive my Guarantee Offer in writing that I will BUY your home before you take possession of your new home when using me, Trevor Shaw as your selling and buying agent. This removes the fear of Buying first or Sell first.

 

Q: How do I get started?

AComplete the on-line guarantee request form located to the left side of this page. Once your home is listed for sale through my Brokerage Re/Max Chay Realty Inc. with me as the listing sales representative a pre-sale inspection will be completed and the Guarantee Sale Program will be considered after the inspection has been done and the property to be sold meets the requirements specified in the terms and conditions on this page. Once the guaranteed sale price and closing date are agreed the 30 day guaranteed marketing period will begin, The Agreement of Purchase and Sale will be signed between the seller and Trevor Shaw, Sales Representative, Re/Max Chay Realty Inc. Brokerage.

 

Q: Why do I have to list my home for sale if you are buying it anyway?

A: The Guaranteed sale is a two step procedure. The Guarantee Sale Program commences 45 days after the property to be sold has been exposed to the market to encourage third party buyers through the MLS system.

 

Q: What happens if I receive a third party offer prior to our agreed closing?

A: Congratulations! The Guarantee Sale will immediately become null and void on receipt of any third party offer received that is equal to or greater than the Guarantee Sale price and you get to keep the difference.

 

Q: Are there any additional costs associated with the Guarantee Sale?

A: As the seller of the property you will pay for the Appraisal, Home Inspection and the Legal Fees associated with the purchase and sale of the property in addition to any HST where applicable.

 

Q: What other details, Terms and conditions should I know.

A: Residential detached homes with market values up to $365,000 and Townhomes up to $300,000 are suitable for this program. No Condo Apartments no Rural properties or properties on septic beds or on wells.

 

Terms of Guarantee:

  1. An independent appraisal (not for bank or insurance purposes) and property inspection upon request.
  2. Sales commission is payable.
  3. Minimum listing period of 90 days
  4. After the 45 day marketing period the Guarantee price will be set at 95% of the agreed sale price between Trevor Shaw and the seller.
  5. The Guarantee becomes null and void upon receipt of third party offer that is equal to or is higher than the guaranteed price.
  6. The Guarantee is null and void if a third party offer is received prior to the agreed guaranteed closing date if Term (5) is satisfied.
  7. No single side sale’s.
  8. Detached residential property valuation cannot exceeding $365,000., Townhomes valuations cannot exceed $300,000.
  9. New to market properties + properties already for sale will be considered.
  10. No rural properties
  11. No properties with septic or on well water
  12.  No aluminum wiring, undisclosed will void any Guarantees already in place.
  13. No condominium apartments.
  14. Multi-residential properties considered based on condition.
  15. Only single family in Barrie City family homes considered
  16. Seller is responsible for all closing costs for the sale and the purchase, Lawyer fees, land transfer tax, federal city and provincial tax’s and fees. A credit in the amount of five thousand Canadian dollars will be provided to offset the purchase cost of legal fees to complete the Guaranteed sale purchase.
  17. The Guaranteed sale price can be published and promoted for marketing after initial 45 day listing period.
  18. The Guarantee agreement of purchase and sale is transferable and assignable at the discretion of Trevor Shaw to any third party.
  19. Upon receipt of a third party offer that is equal to or greater than the Guarantee sale provided the Guarantee sale offer will immediately become null and void and Trevor Shaw will be released from further obligation to complete the Guarantee sale.

Sellers will be provided with an executed Agreement of Purchase and Sale, along with a Schedule “A” attachment containing all contingencies, terms and conditions required for the successful completion of the Guarantee Sale Program, in advance for the purpose of the seller seeking independent legal, accounting, banking and investment advice. New Home to be purchased by seller to be in the same market as the home that is the subject of the Guarantee sale.

 

Seller acknowledges Trevor Shaw is NOT providing Legal, Tax, Investment or other guidance for the purpose of facilitating the Guarantee Sale option. Terms and conditions may change from time to time and may change and be published without notice.
